On April 10, 2010, Ministry of Commerce of the People’s Republic of China issued annual Announcement No. 21, deciding to carry out anti-dumping measures against imports of grain-oriented electrical steel originated in the U.S. and Russia. Among others, the anti-dumping tax rate applicable to VIZ-Stal LTD was 6.3%.
On May 17, 2013, VIZ-Stal LTD filed an application to the Ministry of Commerce, stating the change of its English name from original VIZ-Stal LTD to VIZ-Steel LTD, and requesting the inheritance of the original anti-dumping tax rate applicable to VIZ-Stal LTD by VIZ-Steel LTD; VIZ-Stal LTD also submitted relevant documents before and after renaming such as the registration documents, the articles of associations, shareholders’ information, list of material providers, list of manufacturing equipment, list of sales customers and the certification documents from Chinese Embassy in Russia.
The Ministry of Commerce notified the original anti-dumping measures petitioners, i.e. Wuhan Iron and Steel (Group) Corp. and Baosteel Group Corporation, of the matters with respect to the foregoing application. Within the prescribed time, the petitioners did not express any objection to the matter concerning the inheritance of the anti-dumping tax rate applicable to VIZ-Stal LTD by VIZ-Steel LTD.
Upon examination, the Ministry of Commerce decides that:
I. As of July 26, 2013, VIZ-Steel LTD inherits the original rights and obligations of VIZ-Stal LTD with respect to anti-dumping measures against imports of grain-oriented electrical steel, and an anti-dumping tax rate of 6.3% is levied for the applicable products under investigation exported to China.
II. As of July 26, 2013, the anti-dumping tax rate of 24% applicable to anti-dumping measures against grain-oriented electrical steel under “other Russian companies” shall apply to the products under investigation exported to China under the name of VIZ-Stal LTD.
